Executive summary
FCTC Ratification Process Well Underway
The adaptation of Swiss legislation has already passed two major milestones: the Tobacco Products Regulation governing the manufacturing, marketing and sale of all “tobacco products destined for smoking” has been implemented with inter alia ceilings for tar, nicotine and carbon monoxide levels per cigarette harmonised with those of the EU (excluding exports), and the general advertising and promotion restrictions complying with the FCTC rulings. Second, the consultation period for two new bills - the Working Law (enabling smoking bans in public locations on the basis of employee health protection) and the Tobacco Products Taxation (increasing the tax burden on “other tobacco products”) - has ended and they will be presented to the legislative chambers in 2007 or 2008. After their acceptance the path to ratification is more or less clear.
Health Warnings on Packs soon to have Pictures
The health warnings on packs of cigarettes and the wrappings of “other tobacco products destined for smoking”, as defined by the Tobacco Products Regulation implemented in 2005, will have to be accompanied by a photograph or other graphic image in a new measure, the start date for which has yet to be determined.
Until now, health warnings have had relatively little impact on smokers apart from spreading the knowledge of the harmfulness of the smoking habit and of additives in particular, resulting in rising levels of health consciousness and driving sales of low and ultra low tar cigarettes as well as 100% natural tobacco products.
Cigars and Cigarillos not Affected by Restrictions
Cigars and cigarillos have not been included in the health warnings and smoking bans implemented by several cantons. By contrast, volume and especially value sales rose during 2006, coupled with the return of long-term indications of a new trend towards quality and pleasure-seeking based on record economic prosperity, rising salaries and increased job security. Under these circumstances, forecasts also predict no unexpected tax shocks since other tobacco products will experience rising tax burdens once the new legislation comes into force – tax levels will then climb continually to reach the general EU level, thereby avoiding disturbance to the market.
Smooth Smoking, Flavours and Filter Cigarillos are the Leading Trends
Increased pleasure and new or maximum experiences are the current watchwords, driven by ever higher unit prices for cigarettes. Smooth smoking, mainly among both young and female consumers but also in mid tar cigarettes as well as cigars and cigarillos, flavoured RYO and pipe tobacco and filter cigarillos have boosted value sales in the beleaguered cigarettes and smoking tobacco sectors and have led to increased volume and value sales within cigarillos and small cigars.
Stabilising Cigarettes Sector Drives Volume – Overall and Low Tar
The greatest impact of the changes in Swiss tobacco legislation occurred in 2004-2005, given the eradication of high tar cigarettes, an extensive wave of product launches and withdrawals – with many brands being renamed since denominations such as ‘light’ or ‘mild’ were ruled out - and the biggest tax hike in local history. After a succession of losses, volume sales declined heavily in 2005 as a consequence. Given no tax increases and only moderate industry-led unit price rises in 2006, there were signs of stabilisation once again as actual consumption grew; low tar cigarettes witnessed a steep ascent to become the largest category, and only mid tar cigarettes decreased in terms of volume sales.
