The new US administration suspended all new and pending rules introduced in the last days of the Trump administration, including the freeze on the new finalised rules for premarket tobacco product applications (PMTA) and substantial equivalence (SE) announced in January. Therefore, rules on premarket tobacco applications (PMTA) and Substantial Equivalence (SE) applications came to a halt and will be subject to further review.
A district court judge in Texas delayed again the effective date for graphic health warnings on cigarette packs in the US. The new date is 14 April 2022, pushed back from 14 January 2022.
This was the third delay for the warnings. In May 2020, a court ordered the effective date to be delayed from 18 June 2021 to 16 October 2021, because of the coronavirus. In December, the new requirements were further postponed to 14 January 2022, with the court agreeing with the tobacco industry’s assertion that questions about the validity of the rule remained unanswered.
