In April 2021, the US FDA said that it will work towards developing a regulation banning menthol cigarettes and flavoured cigars (including menthol) within the next year. Menthol is the last flavour allowed in cigarettes still marketed in the US.
In June 2021, DC Council voted to ban the sale of flavoured tobacco products in the district. It joins several other cities across the country in banning menthol cigarettes, along with other flavoured tobacco products, such as candy and fruit-flavoured e-cigarettes.
While the bill that prohibits the US Postal Service from delivering packages containing e-cigarettes was passed in December 2020, up to the 26 April 2021 deadline, USPS had yet to publish a final rule prohibiting the shipping of vapour products.
In April 2019, USPS has published temporary guidance for mailing vaping products in the Federal Register. The notice provides some clarity on USPS policy and outlines potential exceptions, which could include legal hemp and its derivatives.
